Verslo viza Lietuvoje

Verslo viza LietuvojeThis article explains Lithuania’s national visa D requirements for eligible third-country nationals pursuing business activities. A national visa D is distinct from a short-stay Schengen visa C used for business visits.

The European Union is considered by many entrepreneurs as one of the best regions for business expansion and tax optimization. To start your business in the EU, you should consider opening or buying a company in Lithuania. Establishing or purchasing a Lithuanian company does not by itself establish eligibility for a national visa or residence permit. The applicant must meet the requirements of a specific immigration ground. There are no residency-based restrictions for foreigners to establish or buy a company in Lithuania, meaning that foreigners, who want to incorporate a company in Lithuania, have the same rights as the citizens of Lithuania.

When you intend to stay in Lithuania to carry on your business operations, you can obtain a national visa if you are a participant or a manager of a company that was established within one year from the date of submission of the application for a national visa. A Lithuanian Type D Visa is a long-stay or national visa that grants the applicant a stay in Lithuania for more than three months. A foreigner holding a valid national visa (D) may travel to the territories of other states of the Schengen Area.

For the national visa ground based on participation in a newly established Lithuanian company, the applicant must be a participant in a private legal entity registered in the Register of Legal Entities and incorporated within the year preceding the application. The company must have equity of at least EUR 28,000, of which at least EUR 14,000 consists of funds or other assets invested by the applicant. For entities other than ABs and UABs, the threshold concerns asset value rather than equity. A national visa does not by itself authorise employment; the applicable residence permit or statutory exemption must be established separately.

Requirements

In order to be able to apply for a national visa, your company should correspond to the following legal requirements:

  • The company must have been incorporated within the year preceding the national visa application. Purchasing an older company does not restart this period.
  • The value of the company’s equity amounts to at least 28 000 EUR
  • Confirmation that you are a member of the company and the funds or assets invested in your company are at least 14 000 EUR

National visa applications are completed through MIGRIS. Applicants abroad submit their documents and biometric data through an external service provider designated by the Migration Department, subject to the applicable country and nationality restrictions. Applicants legally present in Lithuania apply through the Migration Department. Lithuanian embassies and consulates no longer accept national visa applications, and representation by another Schengen state does not provide a national visa D application route.

A decision on a national visa application is normally made within 15 calendar days of receipt. Where additional examination is necessary, the total examination period may be extended to a maximum of 45 calendar days.

Note that submission of the application is done online, but the applicant must personally visit a service point for biometric information collection and provide the originals or copies of the required documents.

Points to be considered:

  • The national visa is issued for a maximum of one year
  • The national visa is issued for a period of at least 91 days, unless the application for a national visa is submitted in the Republic of Lithuania
  • Submitting a temporary residence permit application does not extend a national visa or independently authorise continued stay or employment. The applicant must retain a valid legal basis for staying in Lithuania throughout the examination period or leave before that basis expires.
