Customer’s right to go to court to resolve disputes

Our company main goal is to provide high-quality customer service and legal and accounting services in all areas of our practice. All disputes and disagreements that may arise during the execution of the contract between the customer and Company in Lithuania UAB will be resolved through negotiations between the parties where possible. If a dispute cannot be resolved through negotiations or another applicable dispute resolution procedure, either party may bring a claim before a court having jurisdiction under Lithuanian law and applicable EU legislation. Depending on the nature and value of the claim, the competent court may be the Vilnius City District Court, the Vilnius Regional Court or another court determined by the applicable jurisdictional rules. Any contractual jurisdiction agreement is subject to mandatory statutory requirements and applicable consumer protection rules.

The right of Company in Lithuania UAB to go to court to resolve disputes

Both clients and Company in Lithuania UAB may seek judicial protection of their rights where a contractual breach, unauthorised disclosure of confidential information or other legally recognised wrongful conduct has occurred. Depending on the circumstances and applicable Lithuanian law, available remedies may include compensation for proven financial losses, contractual remedies or compensation for non-pecuniary damage where legally permitted. Claims must be submitted to a court with appropriate subject-matter and territorial jurisdiction. A contractual breach does not automatically establish liability for reputational or non-pecuniary damage. Company in Lithuania UAB seeks to resolve contractual disagreements through direct communication, internal complaint handling and, where appropriate, mediation or another alternative dispute resolution procedure. If a satisfactory resolution cannot be reached, either party may pursue the legal remedies available under Lithuanian law, subject to the jurisdiction of the competent court. Any claim for compensation or other relief must be supported by the applicable legal grounds and evidence. Submitting a complaint in good faith does not constitute a contractual breach or automatically expose the complainant to liability.

    Procedural costs

Court proceedings in Lithuania may involve a court filing fee (stamp duty), legal representation expenses and other procedural costs, including expert fees, witness expenses and document-related costs. However, the obligation to pay these expenses depends on the applicable procedural rules, the type of proceedings and any available statutory exemptions. A security deposit is not a universal requirement for initiating civil or administrative proceedings. Certain expenses may be payable in advance, while the final allocation of recoverable litigation costs is determined by the court under the applicable legislation. Thus, the plaintiff or complainant is obliged to pay a state fee when filing a claim or complaint. The costs of calling a witness or involving experts must be paid in advance by the participant in the proceeding that wishes to call a witness or involve an expert. Also, a participant in the proceeding is obliged to independently pay for the services of his representative (lawyer).

Under Article 93 of the Lithuanian Code of Civil Procedure, recoverable litigation costs are generally awarded to the party in whose favour the judgment is rendered. Where a claim is partially upheld, costs are generally allocated proportionally to the successful and unsuccessful parts of the claim. The court may depart from the ordinary allocation rules after considering the parties’ procedural conduct and the reasons why the expenses arose. Reimbursement of legal representation costs is also subject to applicable reasonableness standards and statutory limitations. A losing party is not automatically required to reimburse every expense claimed by the opposing party or third parties. Thus, in a civil case, if the court dismisses the claim, the plaintiff is usually obliged to reimburse the defendant for the costs incurred by the latter in connection with the proceeding. If the claim is satisfied, the plaintiff’s costs shall be reimbursed by the defendant. Where litigation costs awarded by a court remain unpaid, the creditor may pursue enforcement of the relevant court decision in accordance with Lithuanian law. Additional enforcement expenses and, where legally applicable, interest may arise. However, penalties and interest are not automatically imposed on every unpaid litigation cost merely because payment is delayed. If a compromise is reached, the costs are usually distributed by agreement of the parties.
