Tributación de las ganancias por criptomonedas de particulares en Lituania

Tributación de las ganancias por criptomonedas de particulares en LituaniaCryptocurrencies are becoming more and more popular not only as a way to invest, but also as a strategy for generating short-term financial gains, too. In Lithuania, the taxation of cryptocurrency transactions by individuals depends on whether the activity qualifies as occasional disposal of personal assets or constitutes independent economic activity. Occasional cryptocurrency transactions are generally taxed under the rules applicable to the disposal of assets not subject to mandatory registration. However, systematic cryptocurrency trading carried out independently, continuously and with the intention of generating economic benefits may qualify as individual activity (individuali veikla), requiring registration with the State Tax Inspectorate (VMI). The classification depends on the actual nature of the activity rather than solely on the number of transactions.

Cryptocurrency gains may arise when crypto-assets are sold for fiat currency, exchanged for other crypto-assets or used to purchase goods or services. Each disposal may constitute a taxable event, even where no funds are withdrawn to a bank account. Merely holding cryptocurrency, including an unrealised increase in its market value, does not generally trigger Personal Income Tax. Income received from mining, staking, rewards or other crypto-related activities may be subject to separate taxation rules depending on its nature and classification.

Taxable Gain = Disposal Value – Documented Acquisition Cost – Eligible Transaction Expenses. For cryptocurrency transactions outside registered individual activity, taxable gains are generally calculated as the difference between the disposal proceeds and the documented acquisition cost, taking into account eligible mandatory transaction expenses and applicable statutory exemptions. When one cryptocurrency is exchanged for another, the market value of the crypto-assets received may be relevant for determining the disposal proceeds and the acquisition cost of the newly acquired assets.

For Lithuanian tax residents whose cryptocurrency transactions do not constitute individual activity, gains are generally taxed under the rules applicable to the disposal of assets not subject to mandatory registration. An annual exemption of EUR 2,500 generally applies to the aggregate qualifying gains from such asset disposals, subject to statutory conditions. From 1 January 2026, taxable gains and other qualifying non-employment income are generally subject to a 15% Personal Income Tax rate up to the annual threshold of 12 average national wages (EUR 27,745.80 in 2026). The portion exceeding this threshold may be subject to progressive rates of 20%, 25% or 32%, depending on the taxpayer’s total relevant annual taxable income.

From 1 January 2026, the taxation of cryptocurrency gains realised outside individual activity is generally governed by the progressive Personal Income Tax rules applicable to qualifying non-employment income. The 15% rate applies up to 12 average national wages (EUR 27,745.80 in 2026). Income exceeding that threshold may be taxed at 20% up to 36 average national wages (EUR 83,237.40), 25% on the relevant portion between 36 and 60 average national wages (EUR 83,237.40 to EUR 138,729), and 32% on the portion exceeding 60 average national wages (EUR 138,729). The applicable thresholds are determined by the relevant tax year. Dividends are generally subject to a separate 15% Personal Income Tax rate and should not automatically be included in the same progressive taxation calculation.

From 1 January 2026, income from registered individual activity (individuali veikla) is generally subject to a 20% Personal Income Tax rate reduced by an applicable income tax credit where annual taxable profits do not exceed EUR 42,500. The effective tax rate is 5% for annual taxable profits up to EUR 20,000 and gradually increases to 20% as taxable profits approach EUR 42,500. Where annual taxable profits exceed EUR 42,500, the income tax credit no longer applies, and the entire relevant taxable income is subject to progressive Personal Income Tax rates of 20%, 25% or 32%, depending on total annual taxable income. Registered individuals may also be required to pay State Social Insurance (VSD) and Compulsory Health Insurance (PSD) contributions, subject to applicable contribution bases, ceilings and exemptions.

Administración de ingresos y plazos

Lithuanian tax residents must report taxable cryptocurrency income in their annual Personal Income Tax return where a declaration is required under the applicable legislation. The standard filing and tax payment deadline is 1 May of the year following the relevant tax period, subject to statutory adjustments when the deadline falls on a weekend or public holiday. Income from occasional cryptocurrency disposals and income from registered individual activity must be declared under the appropriate income categories. Taxpayers should maintain records of acquisition costs, disposal proceeds, transaction dates, exchange rates and relevant fees to support their tax calculations.

Lithuanian banks, financial institutions and certain crypto-asset service providers are subject to applicable transaction monitoring, anti-money laundering and tax information reporting obligations. However, not every cryptocurrency-related payment received through a Lithuanian bank is automatically reported as taxable cryptocurrency income. From 1 January 2026, the EU DAC8 framework introduces additional tax reporting requirements for qualifying crypto-asset service providers, including the collection and reporting of specified information on reportable crypto-asset transactions. The first reporting period generally covers transactions carried out during 2026, with the relevant information reported in 2027. Individuals remain responsible for correctly calculating and declaring their taxable cryptocurrency income, regardless of whether information is separately reported by a bank or crypto-asset service provider.
